Terms of Service

1. Acceptance of Terms

By accessing or using LuxDesign AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms constitute a legally binding agreement between you and LuxDesign AI.

2. Description of Service

LuxDesign AI provides an AI-powered real estate photo editing platform with 14+ tools, including virtual staging, day-to-dusk conversion, decluttering, item removal, photo enhancement, sky replacement, landscaping, pool addition, renovation visualization, and more. The Service operates on a credit-based model where each image generation consumes one credit.

3. User Accounts

To use our Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

• You must provide accurate and complete information
• You must be at least 18 years old to use the Service
• You may not share your account with others
• You must notify us of any unauthorized access

4. Acceptable Use

You agree not to use the Service to:

• Upload content you do not have the right to use
• Generate misleading or fraudulent property representations
• Violate any applicable laws or regulations
• Infringe on any third-party intellectual property rights
• Upload harmful, offensive, or illegal content
• Attempt to circumvent, disable, or interfere with AI safety measures, content filters, or usage limits built into the Service
• Use AI-generated outputs to intentionally mislead prospective buyers or renters beyond the scope of standard virtual staging disclaimers required by MLS and fair housing regulations
• Reverse engineer, decompile, or attempt to extract the underlying AI models, algorithms, or source code of the Service

5. Intellectual Property

You retain full ownership of the original images you upload to the Service. Subject to these Terms, you are granted a perpetual, non-exclusive license to use the AI-generated outputs for your real estate marketing and business purposes.

• LuxDesign AI retains all rights to the platform, technology, algorithms, AI models, and underlying software
• AI-generated outputs may not qualify for copyright protection under current intellectual property law. You use them at your own discretion and risk
• We may use anonymized and aggregated usage data to improve our platform and AI technology. Individual images are not used for model training without your explicit consent
• The LuxDesign AI name, logo, and branding are our trademarks and may not be used without our written permission

6. Payment Terms

Our Service operates on a subscription-based pricing model with optional credit packs:

• Subscription plans: Starter ($29/mo), Pro ($49/mo), Team ($129/mo), and Enterprise tiers ($349/mo–$2,999/mo). Annual billing is available at a discount
• Credit packs: One-time credit purchases are available in Medium (30 credits/$35), Large (65 credits/$69), XL (150 credits/$129), and XXL (400 credits/$249) packs
• Subscription credits are allocated each billing cycle and do not roll over to the next cycle
• Credit pack credits never expire and remain available as long as your account is active
• Each image generation consumes one credit regardless of output resolution
• All payments are processed securely through Stripe. We do not store your payment card details
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for partial billing periods

7. AI-Generated Content

You acknowledge and agree to the following regarding AI-generated content produced by the Service:

• All outputs are generated by artificial intelligence and may contain imperfections, inaccuracies, or artifacts. Results are not guaranteed to be perfect or photorealistic in every case
• You are solely responsible for reviewing all AI-generated outputs before use in any listing, marketing material, or publication
• Virtually staged images must include appropriate "virtually staged" disclaimers as required by your local MLS rules, real estate regulations, and fair housing laws
• LuxDesign AI makes no warranty regarding the accuracy, completeness, or suitability of AI-generated outputs for any particular purpose
• Your uploaded images and generated outputs are not used for AI model training. We may use anonymized, aggregated platform usage data to improve our services

8. Service Availability

We strive to maintain high availability of our Service, but we do not guarantee uninterrupted or error-free access. We may temporarily suspend access for maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by law, LuxDesign AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to loss of profits, data, or business opportunities. Our total aggregate liability for any claims arising from or related to the Service shall not exceed the total amount you paid to LuxDesign AI in the twelve (12) months preceding the event giving rise to the claim.

10. Termination

Either party may terminate this agreement at any time:

• You may cancel your account at any time through your account settings or by contacting support
• We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion with reasonable notice
• Upon termination, your right to use the Service ceases immediately. Account data will be deleted in accordance with our Privacy Policy
• Any unused subscription credits or credit pack credits are forfeited upon account cancellation or termination
• Sections regarding Intellectual Property, Limitation of Liability, and Dispute Resolution survive termination

11. Dispute Resolution

Any disputes arising from or relating to these Terms or the Service shall be resolved as follows:

• Governing law: These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions
• Binding arbitration: Any dispute, claim, or controversy shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall take place in California
• Class action waiver: You agree to resolve disputes only on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration. You may opt out of this class action waiver by sending written notice to legal@luxdesign.ai within 30 days of accepting these Terms
• Exceptions: Either party may seek injunctive relief in a court of competent jurisdiction for claims involving intellectual property infringement or unauthorized access to the Service

12. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of any material changes by email or by posting a notice on our website. Your continued use of the Service after such changes constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Service.
